This
is a License Agreement ("Agreement") made between Omni
Multimedia Network Int’l, LLC
("Omni Internet") and the User of Omni Internet's
Internet Access Service ("User"). A User of Omni Internet's
service is defined as any person or company holding a valid account
with Omni Internet, or any person or company using a valid account
with or without the permission of the account holder. This Agreement
may be revised at any time without notification, and the most current
version will be made available to User at User's request. This Agreement
constitutes the entire agreement between the parties with respect
to the subject matter and supersedes all prior agreements or communications.

PAYMENT
FOR SERVICE
|
|
Omni
Internet accepts VISA, MASTERCARD, AMERICAN EXPRESS, and DISCOVER
credit cards as well debit cards, Cash (at Omni Internet's office),
and Checks or Money Orders. Users are solely responsible for any
and all fees incurred through the use of their account. Contact
Omni Internet for current payment methods and pricing.

PREPAID
ACCOUNTS:
|
|
All
prepaid accounts start on the day service is activated and terminate
at the end of that term. Monthly prepaid accounts run from the start
of the service and continue to the end of the month and may not
be put on hold for any reason. Annual prepaid accounts may be put
on hold during times of extended absence by making prior arrangements
in person at Omni Internet’s offices, and User will not be charged
for the time the account is placed on hold.

GOVERNMENTAL
LAW
|
|
This
Agreement shall be construed and controlled by the laws of the State
of Texas. User agrees to abide by all applicable Federal, State
and local laws governing their behavior on the Internet including
but not limited to laws concerning harassment, copyright, obscenity
and information dissemination. Note that the Internet is not above
the jurisdiction of all laws. The User is solely responsible for
his or her actions and the actions of anyone using their account(s).

NATURAL
LAW
|
|
Whereas
the Internet is not a controlled environment, Omni Internet holds
that it is not responsible for any portion of the Internet with
respect to downtime or accessibility that is out of Omni Internet's
direct control. Omni Internet will make every effort to assure that
Omni Internet's own computer network is operating with as little
interruption and downtime as possible.

IMPERSONATION
|
|
User
will not impersonate anyone else online via E-mail, IRC (Internet
Relay Chat) or any other forum. Impersonation includes but is not
limited to using someone else's Internet address, username, or legal
name. Remaining anonymous and the use of anonymous re-mailers is
acceptable.
|
|
SPAMMING
|
|
User
will not participate in any activity which could be called spamming.
Spamming includes but is not limited to mass unsolicited e-mailings
to more than 19 people, posting 20 or more copies of a single article
to a USENet newsgroup, or cross posting to more than 20 newsgroups,
or repetitive posting of off-topic articles to any newsgroup.

COMMERCIAL
ACTIVITY
|
|
Commercial
activities on Omni Internet's systems are prohibited on non-business
accounts. No business or business name can be in User's default
home page, and the User's home pages cannot advertise anything but
personal information. Omni Internet does offer special Business
oriented accounts. Contact Omni Internet sales at (830) 257-6664

|
UNLIMITED
ACCESS
|
|
Omni
Internet's policy for unlimited personal dialup accounts allows
customers to remain connected as long as they are physically in
front of their computer and interactively using their Internet connection.
Typically this does not occur for more than 24 consecutive hours.
When you are not physically sitting at your computer interactively
using your Internet connection, you must disconnect. Only one concurrent
connection per dialup account is allowed. If at OMNI’s discretion,
an account is consistently staying connected for over 12 hours each
day, OMNI may require account termination or conversion to another
class of account.

User
WEB SITES
|
|
Omni
Internet supports both personal and business websites. Each site
is allowed a specified amount of disk usage and external throughput
from the site per month. As needed, users may use more than their
allotted disk space. If an account's average (polled over the course
of one month) disk usage exceeds their allotment, an additional
fee will be assessed on a per megabyte basis. Similarly, if the
total throughput generated from hits to a website from OUTSIDE Omni
Internet's network exceeds the allotted throughput, a fee will also
be assessed on a per quarter gigabyte basis. Call Omni Internet’s
offices during normal business hours for current limits and rates.

DISCONTINUATION
OF SERVICE
|
|
Omni
Internet reserves the right to discontinue service to anyone at
any time. Should Omni Internet deem it necessary to discontinue
service, the User will be responsible for all charges on their account
as of the date of termination. Should a refund be necessary, the
refund will be prorated as of the date of termination.
